The licensor of Portmark, for the purposes of the Elastic License 2.0, is named in
LICENSE itself, above the license text.

Contributors retain copyright in their own contributions, and license them to the
licensor under the agreement in CLA.md, which must be signed before a contribution
is merged.

Current license

Portmark is available under the Elastic License 2.0. The full text is in LICENSE.

In plain terms, and without replacing or narrowing that text: you may use, copy,
modify and redistribute Portmark, including inside your own commercial product and
including deployment inside your own organization at any scale, at no charge. What
you may not do is provide Portmark to third parties as a hosted or managed service
where the service provides users with access to any substantial set of the features
or functionality of Portmark.

Where this summary and LICENSE differ, LICENSE governs.

The Elastic License 2.0 is a source-available license. It is not an OSI-approved
open-source license, because it restricts one field of use. Portmark states this
plainly rather than describing itself as open source.

Earlier versions remain MIT, permanently

Every version of Portmark up to and including the commit tagged `last-mit` was
released under the MIT License, whose text is preserved in legal/LICENSE-MIT. That
grant is perpetual and is not withdrawn by this change. It covers:

  * every commit up to and including the `last-mit` tag; and
  * the PyPI releases 0.1.0, 0.2.0, 0.3.0, 0.3.1, 0.4.0, 0.4.1, 0.6.1, 0.8.0,
    0.9.0, 0.9.1 and 0.9.2.

Anyone who obtained any of those may continue to use them under the MIT License
for as long as they wish. Nothing here asks for those rights back.

The Elastic License 2.0 applies only to commits made after the `last-mit` tag,
and to releases made from them.

Additional grant: the dormancy grant
--------------------------------------------------------------------------------

Portmark is a security boundary. Depending on one is a long commitment, so every
recipient of Portmark receives the following additional license at the same moment,
and on the same terms, as the license in LICENSE. It adds to that license and
narrows nothing in it.

**The grant.** The licensor grants you, now and irrevocably, a perpetual,
worldwide, non-exclusive, royalty-free license under the Apache License, Version
2.0, to the release of Portmark you received and to every earlier release of it.
That license is granted to you when you receive Portmark. You may exercise it only
once Portmark is dormant, as defined below, and from then on you may exercise it in
full.

Because this license is granted at the moment you receive Portmark, it does not
depend on the licensor doing anything later, and a subsequent owner of the
copyright takes subject to it.

**A Qualifying Maintenance Event** is either of the following, applied to Portmark
itself rather than to the material around it:

  (a) the publication of a release of Portmark; or
  (b) a change merged into the default branch of
      <https://github.com/Itsthewayofyou/portmark> that fixes a security problem,
      fixes a defect, restores or extends compatibility, or adds to or changes
      Portmark's functionality.

The following are **not** Qualifying Maintenance Events, however they reach the
default branch: automated dependency updates; changes only to documentation,
comments, formatting, tests, licensing or project metadata; and changes made by
automation without human review.

**Portmark is dormant** when both of the following have happened:

  (i)  twelve consecutive months have passed with no Qualifying Maintenance Event;
       and
  (ii) a person has published a written request for confirmation that Portmark is
       still maintained -- by opening a public issue at
       <https://github.com/Itsthewayofyou/portmark/issues> or by writing to the
       licensor -- and thirty days have passed after that request with still no
       Qualifying Maintenance Event.

If the repository named above is unavailable, or no means of making the request is
published, (ii) is not required and Portmark is dormant at the end of the twelve
months.

The thirty days exist only so that the grant cannot become exercisable while nobody
has yet noticed that Portmark is dormant. They are not an opportunity to defeat it:
the request may be made by anyone, at any time once the twelve months have passed,
and as often as necessary.

**Once Portmark is dormant it stays dormant.** Maintenance resuming afterwards does
not withdraw a license that has already become exercisable, and cannot: the license
was granted when you received Portmark, and the licensor cannot revoke it.

Trademarks
--------------------------------------------------------------------------------

The Elastic License 2.0 grants no trademark rights. "Portmark" and the Portmark
logo are marks of the licensor. TRADEMARKS.md says what is permitted without
asking, and what is not.
